Privacy Policy of the e-shop modernatex.cz

  1. Boaz, s.r.o., with its registered office at Holečkova 431/19, 150 00, Prague 5 - Smíchov, ID 27064328, file number C 93652 registered at the Municipal Court in Prague (hereinafter referred to as the "seller" or "controller") processes, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation"), the following personal data:
    • first name, last name
    • email address
    • phone number
    • address/registered office
  2. The above personal data is necessary to process orders and other obligations arising from the contract if a purchase agreement is concluded between you and the seller. Such processing of personal data is permitted by Art. 6 paragraphs. 1 letter. b) Regulation – processing is necessary for the performance of a contract.
    The seller also processes this data for the purpose of contract registration and potential future enforcement and defense of the rights and obligations of the contractual parties.
    The retention and processing of personal data is for the aforementioned purpose for a period of 10 years from the execution of the last part of the performance under the contract, unless another legal regulation requires the retention of contractual documentation for a longer period. Such processing is possible based on Art. 6 paragraphs. 1 letter. c) and f) Regulation – processing is necessary for compliance with a legal obligation and for the purposes of the legitimate interests of the controller.
  3. News and other commercial communications may be sent to the buyer's email address or phone number, this procedure is allowed by § 7 paragraph. Section 3 of Act No. 480/2004 Coll., on Information Society Services, unless the buyer refuses it. These communications can be unsubscribed from at any time in any way – for example, by sending an email or clicking on a link in the commercial communication.
  4. We assess your satisfaction with the purchase through email surveys as part of the Verified by Customers program, in which our e-shop is involved. We send these to you every time you make a purchase with us, in accordance with § 7 paragraph. You do not refuse their sending under Section 3 of Act No. 480/2004 Coll. on Certain Information Society Services. The processing of personal data for the purpose of sending questionnaires within the Verified by Customers program is carried out based on our legitimate interest, which lies in determining your satisfaction with your purchase from us. For sending questionnaires, evaluating your feedback, and analyzing our market position, we use a processor, which is the operator of the Heureka.cz portal; for these purposes, we may provide them with information about the purchased goods and your email address. Your personal data is not shared with any third party for their own purposes when sending email surveys. You can object to receiving email surveys as part of the Verified by Customers program at any time by refusing further surveys using the link in the survey email. In case of your objection, we will no longer send you the questionnaire.
  5. The processing of personal data is carried out by Boaz, s.r.o., the data controller. Personal data for this controller are also processed by processors:
    • Service provider BINARGON s.r.o., Hlavní 107, 738 02 Frýdek-Místek;
    • Service provider Heureka, operated by Heureka Shopping s.r.o., registered office at Karolinská 650/1, 186 00, Prague 8-Karlín

    Personal data will not be transferred to third countries outside the EU.

  9. Cookies collected for the purpose of measuring website traffic and creating statistics related to website traffic and visitor behavior are considered in aggregate form and in an anonymous manner that does not allow for individual identification.
  10. The collected cookie files may be processed by other processors:

  11. Please note that according to the Regulation, you have the right to:
    • cancel the sending of commercial communications at any time,
    • object to processing based on the legitimate interest of the controller,
    • request information from us about what personal data of yours we process,
    • request access to this data and have it updated or corrected, or request a restriction of processing,
    • request the deletion of this personal data, which we will carry out unless it contradicts applicable legal regulations or the legitimate interests of the controller,
    • data portability, if it concerns automated processing based on consent or for the purpose of fulfilling a contract,
    • request a copy of the processed personal data,
    • effective judicial protection if you believe that your rights under the Regulation have been violated as a result of processing your personal data in violation of this Regulation,
    • file a complaint with the Office for Personal Data Protection.
